The acquisition date…explained

The acquisition date is the date on which the RTM company formally takes control of the management from the landlord:

  • where the landlord has not disputed the claim, the acquisition date will be the date specified in the company’s Notice of Claim issued;
  • where there was a dispute which was determined in favour of the RTM company by the LVT, then the acquisition date is a date three months after the determination by the LVT becomes final;
  • if the landlord originally disputed the claim but subsequently agreed in writing that the company was entitled to the right, the acquisition date is three months after the date of that agreement made allowing the Right to Manage company to procced.
